DAYTON–A sentencing hearing for Benjamin Orozco, who was convicted of second-degree murder and first-degree assault following a three-and-a-half day trial last August, has been set for 1:30 p.m., Wednesday, January 15 in the Columbia County Superior Court, according to Prosecuting Attorney C. Dale Slack.

Orozco was convicted by a Columbia County jury of murdering Lance Terry on July 7, 1996, and wounding David J. Eaton, in a confrontation at Main and 2nd streets. The jury deliberated for 1½ hours before finding Orozco guilty on all counts.

The sentencing range for second-degree murder, with firearms enhancements, is 196 to 238 months, said Slack. For first-degree assault, with firearms enhancements, standard sentencing is 162-196 months, and for unlawful possession of a firearm, it is 4-12 months. The sentences would run concurrently, according to Slack.
